Trial Terms of Service

These Terms of Service (the "Terms") govern access to and use of the OptiWize Cloud free trial ("Trial") offered by evoseed S.r.l., registered office at Via Lucrezio 13 — 34134 Trieste (TS), Italy, VAT 01361650326 ("evoseed", the "Provider" or the "Controller"). Submission of the "Free 30-day Trial" form on beta.optiwize.cloud or optiwize.cloud constitutes full acceptance of these Terms.

1. Definitions

  • Service: the OptiWize Cloud multi-tenant SaaS platform for MikroTik device management, operated by evoseed.
  • Trial: the free 30-day evaluation version of the Service, with the limitations stated below.
  • Customer: the natural or legal person registering for the Trial via the form published on the Site.
  • Trial Account: the dedicated tenant created automatically for the Customer upon form confirmation.
  • Documentation: the technical materials, guides and tutorials published by evoseed on the Site or made available within the Trial Account.

2. Scope and limitations of the Trial

The Trial allows the Customer to evaluate the Service for a period of 30 calendar days from activation of the Trial Account, under the following conditions:

  • maximum 10 MikroTik devices managed concurrently;
  • access only to the features of the OptiWize Cloud Core plan — SD-WAN, Content Filtering, NIS2 Compliance Pack, multi-vendor (AVSystem, AXIROS, Huawei) and white-labeling features are excluded;
  • no service-level guarantee (SLA): the Trial is provided "as is" and "as available";
  • no guaranteed backup or bulk data export after the Trial ends.

3. Registration, account and credentials

The Customer shall provide accurate, complete and up-to-date information. evoseed reserves the right to refuse activation or to suspend the Trial Account in case of manifestly false information, disposable email addresses or multiple requests from the same subject.

Access credentials are personal; the Customer is responsible for their safekeeping and for any activity carried out through the account. Any unauthorised access must be promptly reported to [email protected].

4. Acceptable use

The Customer shall not:

  • use the Trial in business-critical production environments or to provide services to third parties without a separate commercial agreement with evoseed;
  • resell, sublicense or commercialise the Service in any form;
  • reverse-engineer, decompile or attempt to gain unauthorised access to the infrastructure;
  • upload unlawful content, content infringing third-party rights or content contrary to mandatory laws;
  • use the Trial for stress testing, unauthorised security scanning, mass scraping or flooding;
  • circumvent technical limits (device count, Core features) via technical tricks, multiple accounts or fake headers.

Violations of the acceptable-use rules will result in immediate suspension of the Trial Account and, where applicable, the right of evoseed to report the abuse to the competent Authorities.

5. Service availability

evoseed will provide the Trial with appropriate technical diligence, but does not guarantee continuity of service nor specific recovery times. Scheduled maintenance windows or urgent interventions without prior notice are allowed. Use of the Trial in business-critical production scenarios is expressly discouraged.

6. Duration, withdrawal and termination

The Trial lasts 30 days. Upon expiry, evoseed may, at its discretion:

  • offer the Customer to subscribe to a paid plan under separately agreed terms;
  • extend the Trial free of charge in specific cases, upon written communication;
  • deactivate the Trial Account and delete the associated data, except for technical logs and legal-obligation retention.

The Customer may withdraw from the Trial at any time, without justification, by writing to [email protected]. evoseed will deactivate the Trial Account within 5 business days.

7. Intellectual property

The Service, the software, the Documentation, the logos, the trademarks and any other related element remain the exclusive property of evoseed or of the respective holders. No intellectual-property right is transferred to the Customer by virtue of the Trial. Only a temporary, non-exclusive, non-transferable and revocable licence is granted to the Customer, limited to the purpose of evaluating the Service.

8. Customer data and confidentiality

Data relating to devices managed by the Customer through the Trial (configurations, telemetry, logs) remain the property of the Customer. evoseed processes such data as a Processor under Article 28 GDPR, solely for the provision of the Service. Further details are governed by a Data Processing Agreement (DPA) available upon request.

The Customer's personal data (identification, contact details) is processed in accordance with the Privacy Policy.

9. Disclaimer of warranties

To the extent permitted by law, the Trial is offered "AS IS", without express or implied warranties of merchantability, fitness for a particular purpose, non-defectiveness or non-infringement of third-party rights. evoseed does not warrant that the Trial is free from bugs, interruptions or vulnerabilities.

10. Limitation of liability

evoseed shall not be liable, to the extent permitted by law, for indirect damages, loss of profits, loss of data, business interruption or reputational damage arising from the use or inability to use the Trial. evoseed's aggregate liability for any claim arising from the Trial is in any event limited to the symbolic amount of one hundred euros (EUR 100). This limitation does not apply in case of wilful misconduct, gross negligence or where prohibited by mandatory law.

11. Changes

evoseed reserves the right to amend these Terms at any time. Material changes will be communicated on the Site or via email; continued use of the Trial after the changes take effect constitutes acceptance of the changes.

12. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute is subject to the exclusive jurisdiction of the Court of Trieste, Italy, without prejudice to the mandatory jurisdiction of consumer courts where applicable.

13. Notices

Communications to evoseed must be sent to the certified email [email protected] or to [email protected]. Communications to the Customer are sent to the email address provided at registration.
